Raleigh Spousal Support Lawyers

Getting by after a divorce can be especially difficult for people who are financially dependent on their spouses. North Carolina courts try to help people in this difficult situation by allowing for certain kinds of spousal support. This can be given in the form of either post-separation support or alimony.

Raleigh spousal support lawyers Marshall & Taylor, P.C., are aware of the ways that these laws can be useful, and how they can be abused. If you are a dependant or supportive spouse going through divorce or separation, contact our offices at 919-833-1040. Our experienced attorneys can answer your questions about topics such as:

How Spousal Support is Determined

A divorcing or separating couple may make their own spousal support arrangements, if they are able to agree on a fair amount. If they cannot, the dependant spouse can file a claim to receive support. A judge will hear evidence from both sides and decide how much support, if any, to award.

If the couple is separated, the dependant spouse may file for post-separation support. This is meant to be temporary assistance during the period between becoming separated and filing for divorce. At the end of this period, the dependant spouse may be awarded alimony, or the financial support may end altogether.

Judges are given a large degree of discretion when determining spousal support amounts. They consider many different factors in making their decisions, including but not limited to:

  • The dependant spouse’s needs
  • The supportive spouse’s income
  • Any marital misconduct committed by either party

After considering this information, judges can order regular payments, a lump sum payment, or find the dependant spouse ineligible for spousal support.
