The state of North Carolina recognizes two kinds of divorce: divorce from bed and board, and absolute divorce. The former actually has a misleading name, because it is not a divorce. It is a legal separation. Filing for absolute divorce is the only way to fully break the legal contract between husband and wife.
People can only file for divorce if they have lived in North Carolina for at least six months. The most common grounds for divorce are separation between the spouses for at least one year. This means that if you are considering divorce from your spouse, you may need to begin with a separation. Incurable insanity is the only other grounds for divorce, but it is rarely used.
The average Raleigh divorce takes about 35 – 40 days to complete. The legal steps are fairly simple: file for divorce, deliver the complaint to your spouse through the sheriff or certified mail, and allow your attorney to work out property division and other issues.
