How will the judge decide who gets custody of our kids?

If you and your ex-spouse cannot make a child custody arrangement between yourselves, a judge (or an arbitrator) will rule on your case. When making his or her choice, the judge will consider many different factors, including: the relationship the children have with each parent; each parent’s income and living situation; each parent’s treatment of the children during the marriage, and any other factors the judge considers relevant.
