Glossary of Divorce Kit Forms
Many of the forms in our Divorce Kit follow forms created by the North Carolina Administrative Office of the Courts. All forms are legally correct, however, as we previously mentioned you may occasionally encounter a troublesome clerk or judge who is very particular about how he or she wants the forms. If you encounter any problem with our Divorce Kit forms being accepted by the clerk or judge, you can try one of more of the following:
- Ask the clerk or judge what is wrong with your form, then try to change it to suit the clerk or judge.
- Consult a lawyer.
If you are unable to type the forms that we have provided, you can print the information required in the forms. Just be sure to use black ink and make sure your handwriting can be easily read by someone other than yourself.

Summons: This form serves as formal notice that a civil lawsuit has been instituted. It gets attached to the complaint and verifies service when a sheriff’s office is used.
Complaint for Divorce: This is the form that you file to start the divorce process. It is the lawsuit for divorce.
Verification: Your written statement that the facts as alleged in your complaint, or other documents, are true and accurate to the best of your knowledge. You will need to sign and date the form in the presence of a notary public.
Affidavit of Service: Your statement made under oath that you served the document in the manner specified.
Notice of Hearing: Give formal notice of the date, time and place of the actual divorce hearing. For an absolute divorce, notice must be given at least 5 days before the hearing and an additional 3 days are added to account for the time it takes to mail the document. Thus, 8 full days of notice must be give before the divorce hearing.
Divorce Judgment: This is the legal document that grants your divorce.
Certificate of Service: Your verification that you sent the documents to your spouse in the manner specified.
