Father’s Rights - NC

If you are a father that is going through a divorce or separation, you may be confused about what rights you have when it comes to your children. North Carolina has abolished a maternal preference or presumption that custody should be awarded to the mother, despite whether the child is born inside of or out of wedlock. If both parents are fit and proper to have custody then the court will look at a variety of factors to determine custody including but not limited to morality, wishes of the child(ren), spiritual well-being (not religion), and domestic violence. The concern is focused on what is in the best interests of the minor child(ren). The father’s rights are important when it comes to making the best possible decision for the future and well-being of the children involved.

If you want to know more about father’s rights and how they relate to child custody in North Carolina, please contact us for a confidential consultation. We’re here to help you create the best possible outcome for your family during this process.
