The Case for Annulment

An annulment and a divorce are often grouped togetherbecause of their similarities, but there is a large difference between them.The two are similar in the sense that the legal relationship that began inmarriage comes to an end. The difference, however, is that when a marriage isannulled it is legally treated as if it never happened. This means eitherspouse can claim to have never been married on taxes and other officialdocuments.

In North Carolina a marriage can only be annulled for a fewreasons:

A husband and wife are more closely related than firstcousins.

The husband had been diagnosed with chronic medicalimpotency at the time of marriage

Either spouse was mentally incompetent to enter a legalcontract at the time of marriage

Either party was under the age of 16 at the time ofmarriage.
