Parents who smoke could lose custody of their children

Action on Smoking and Health, an advocacy group that is against tobacco use, recently gathered data related to child custody cases and smoking. Their findings indicate that several United States courts are beginning to put a large emphasis on smoking around minor children.

Non-smoking parents are being awarded custody on a more regular basis. These parents are also using evidence in court that their former spouse is a smoker in order to obtain these custody outcomes. Smokers are not granted full custody due, in part, to the negative side effects of their harmful habits.

Numerous court rulings showcase these beliefs on tobacco use among parents of minor children. A man in Georgia took his ex-wife to court over the custody of their young daughter. He presented evidence showing that their daughter developed asthma, and his ex-wife, a smoker, continued to smoke cigarettes in her presence. The judge in the case awarded full custody to the father.

Shooting between agents at the California Immigration and Customs Enforcement office

Last Thursday evening, a California Immigration and Customs Enforcement officer, Ezequiel Garcia, shot Kevin Kozak, his superior officer, six times.

The shooting was said to be incited from an argument during Garcia’s performance counseling.  Fortunately, Kozak is in stable condition.  Garcia was shot and killed by a third officer nearby.  It was stated by Garcia’s wife that they were considering divorce after 14 years of marriage.  She believes that Garcia’s actions could be related to the pending divorce.

“We are doing everything humanly possible to understand why it happened and ensure it will not happen again,” said Special Agent in Charge, Claude Arnold.

 

Duke’s final home wrestling match of the regular season

Raleigh divorce attorneys of Marshall & Taylor, P.C. are excited to announce the final home match for the Duke Blue Devil wrestling team on Friday.

At 6:30pm on Friday, the Blue Devils will compete against NC State and Ohio University for its last home match of the regular season.  The start of the meet will take place on mat two against NC State at 6:30pm, and the second portion will take place on mat one against Ohio at 7:15pm.

Seniors Nick Adamo, Dan Adamo, Nico Cortese, Dak Adamson, A.J. Guardardo, and Chris Mullen will be recognized before the match begins.

California’s gay marriage ban is ruled unconstitutional

On Tuesday morning, the U.S. Ninth Circuit Court of Appeals in San Francisco ruled that Proposition 8, the ban on gay marriage in the state of California, is unconstitutional.

Proposition 8 was a voter-mandated ban on gay marriage that came into effect in November of 2008.  Tuesday’s historic decision was made by 2-1 vote of justices in the Ninth Circuit Court of Appeals.  The panel stated that the gay marriage ban in California “used the state’s initiative power to target a minority group and take away a right the group possessed, without legitimate reason.”

Judge Stephen Reinhardt, who was appointed by former President Jimmy Carter, stated, ”Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples.”

Same-sex marriage opponents will most likely appeal this decision, and it is unclear whether they will decide to try the case in front of the same court with a 14 judge panel or move directly to the Supreme Court.

The mother of all football games-Super Bowl XLVI

Raleigh divorce attorneys of Marshall & Taylor, P.C. are delighted to discuss the 2012 Super Bowl this Sunday at Lucas Oil Stadium in Indianapolis.

The New York Giants and the New England Patriots meet on Sunday to play in the biggest football of the year at Super Bowl XLVI.  The Giants played the Patriots in the 2008 Super Bowl and won the game upsetting the Patriots’ 18-0 record.

Eli Manning, quarterback for the Giants, led his team to victory during the last three games against the Atlanta Falcons, the Green Bay Packers, and the San Francisco 49ers.  They now have a 12-7 record and plan to come out on top over the 15-3 Patriots.

Klum and Seal separate

Singer Seal and his supermodel wife, Heidi Klum, have announced their separation.

Much to the surprise of their friends and to the public, Heidi Klum and Seal have separated after seven years of marriage.  Seal visited the “Ellen DeGeneres” and “Tavis Smiley” shows over the past few days to promote his new album, Soul 2, and made statements about the couple’s split.  Seal said, “She is still, in my opinion, the most wonderful woman in the world…I think our priority was to remain civil and do this thing with dignity. We still very much love each other.”

It is clear that this will not be an ugly Hollywood divorce.  The couple has four children, and though Seal has made statements about the situation, there is not a clear reason for the split.

Duke vs. Virginia swimming and diving meet this Friday

Raleigh divorce attorneys of Marshall & Taylor, P.C. are excited to announce Duke University’s first Atlantic Coast Conference swim meet against Virginia this Friday.

At 5pm at the Taishoff Aquatic Pavilion, Duke’s men’s and women’s swimming and diving teams will host Virginia.  Last weekend, Duke competed against Queens and South Carolina.  Three of four relay events were won by the Blue Devils.

Jessica Lyden of the Duke diving team placed second in the 1-meter and 3-meter events. Head coach Dan Colella said, ”We’re excited about being home for the first time this season and swimming the Cavaliers.”

Shriver proceeds with divorce from Schwarzenegger

Maria Shriver, 56, former first lady of California, is moving forward with her divorce from Arnold Schwarzenegger after some speculation that the two would reconcile.

TMZ.com, a Hollywood gossip website, stated that Shriver was making attempts to get back together with Schwarzenegger, but the New York Daily News confirms otherwise.

On July 1, Shriver filed for divorce from Schwarzenegger after discovering that he had sired a child with the family’s housekeeper, Mildred Baena.  The truth came out when Shriver approached Baena about the resemblance of the child to Schwarzenegger.

Katy Perry and Russell Brand split

Singer Katy Perry and actor/comedian Russell Brand have called it quits when Brand filed for divorce on Dec 30.

Fans were shocked when the couple decided to split after just 14 months.  According to Forbes magazine, Perry made $45 million during their marriage and Brand has claimed that there was no prenuptial agreement signed, which means Brand is entitled to half of that money.  Brand’s salary during their marriage was somewhere between $6-8 million.

Christmas events in Raleigh this weekend
