The Case for Annulment

by Administrator 6. November 2009 05:19

An annulment and a divorce are often grouped togetherbecause of their similarities, but there is a large difference between them. The two are similar in the sense that the legal relationship that began inmarriage comes to an end. The difference, however, is that when a marriage isannulled it is legally treated as if it never happened. This means eitherspouse can claim to have never been married on taxes and other officialdocuments.

In North Carolina a marriage can only be annulled for a fewreasons:

A husband and wife are more closely related than firstcousins.

The husband had been diagnosed with chronic medicalimpotency at the time of marriage

Either spouse was mentally incompetent to enter a legalcontract at the time of marriage

Either party was under the age of 16 at the time ofmarriage.

If you or someone you know is considering divorce, it isimportant to find an attorney you can trust, one who will work to reduce yourstress as much as possible in what can be a highly emotional and confusingsituation.
