New Bill Changes NC Marital Law

A new North Carolina lawwill block jilted spouses from suing third parties over lost love and affection.The change of law, which was signed in August by Governor Beverly Perdue,changes the rules on the legal theories known as alienation of affection andcriminal conversation. Those rules would allow an individual whose spouse takesup with another person to sue for money damages.

The new law will becomeeffective Oct. 1 and will only apply to acts occurring after that date. Underthe newly rewritten law, a third party who begins a relationship with a marriedperson can no longer be sued by the spouse for alienation of affection orcriminal conversation, but only if the spouses were separated when therelationship began.

North Carolina is one ofonly five states that still recognizes the tort of alienation of affection. Therevised law is consistent with the state’s alimony statute that cuts off claimsof adultery and marital misconduct in support of alimony after the date of separation.

Rockingham County Leads North Carolina in Divorce

According to the newnumbers released by the U.S. Census Bureau, Rockingham County leads NorthCarolina in Divorce, with a rate of 15 percent.

That’s more than 4percent higher than the national average of 10.7 percent. According to thestatistics four percent of Rockingham County residents are separated, and only53 percent of residents are married.

Many residents pointedto the struggling economy, and especially the loss of textile jobs, as beingthe main culprit behind the rise in divorces. Pastor William Duke, of the FirstBaptist Church in Reidsville, said the loss of jobs creates stress inmarriages. Unemployment can threaten traditional roles, especially for men,said Duke.

The second highest onthe list is Randolph County, with a 12 percent divorce rate. Guilford andDavidson counties followed with 11 percent.

Indiana and Florida have Highest Divorce Rate Counties

A recent study was conducted based on census information comparing divorce rates.  The census information has shown that two counties in Indiana and Florida are considered the counties with the highest percentage of divorced individuals.  In these counties,  the percentage of individuals who are divorced is nearly 20% each.

Several other counties across the United States had divorce numbers that were similar as well.  The study also pointed out that the number of unmarried  people was increasing  number of individuals who are unmarried.  This number has been statistically increasing for the last ten years.

The basics of alienation and affection lawsuits

In common law, alienation of affection is a tort that a spouse brings against a third party, claiming that the third party is at fault for the marriage's failure. Alienation and affection lawsuits usually are brought against adulterous spouse's lover, when one spouse cheats on another. However, defendants can also include relatives, friends, counselors, or clergy. 

Although the law used to be prevelant across the United States, many states have rejected the law. In North Carolina, the law still exists. The law, however, varies by states.

Nevada Creates Child Support Task Force

In Nevada, a new task force has been created to collect child support payments from delinquent parents. Under the current system, the state has been inefficient in collecting these payments.

In 2008, the state collected approximately 52% of owed payments. The new state task force is expected to do a better job at tracking down parents who are criminally delinquent.

T-Pain Sued for Child Support

Musical artist T-Pain is being sued for unpaid child support. He allegedly fathered a child out of wedlock two years ago. He has since offered the mother $500 monthly payments in child support which were turned down.

The woman is now suing T-Pain for larger payments. While there is no official word, it is believed that the two parties will be going to court in the near future to determine child support payments.
